Rules of the road.

1. Acceptance of Terms

By accessing or using BrainFusion (brainfusionlearning.com), you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.

These terms apply to all users, including educators, administrators, corporate trainers, and individual learners who create accounts. Learners who join games via session codes without creating accounts are not bound by these terms, as they do not register or provide personal information.

2. Account Registration

To create games, access analytics, and use premium features, you must create an account. When registering, you agree to:

• Provide accurate and complete information (a valid email address)
• Keep your password secure and not share it with others
• Notify us immediately if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You must be at least 13 years old to create an account. If you are under 18, you must have permission from a parent or guardian.

3. Payments and Subscriptions

BrainFusion offers a free plan and paid subscription plans (Spark, Fusion, Supernova). By subscribing to a paid plan, you agree to the following:

• All payments are processed securely through Stripe. BrainFusion does not store your credit card information.
• Subscriptions are billed on a recurring basis (monthly or annually) and will automatically renew unless cancelled.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain access to paid features until then.
• Refunds are handled on a case-by-case basis. Contact support@brainfusion.games for refund requests.
• If a payment fails, we may restrict access to paid features until the payment issue is resolved.

The free plan includes up to 5 games and 3 one-time AI generation credits. Paid plans include unlimited games and additional AI credits.

4. AI Credits

AI credits are used to generate game content (questions, answers, and distractors) via artificial intelligence. Each AI-generated game consumes 1 credit.

• Credits are purchased in bundles and never expire
• Credits are non-transferable between accounts
• Credits are non-refundable once purchased, except at our discretion
• If AI generation fails due to a system error, the credit is automatically refunded to your balance
• AI-generated content is created using OpenAI's API. While we strive for accuracy, AI-generated content may contain errors and should be reviewed before use

5. Content Ownership

Your content: You retain ownership of the games, questions, and educational content you create on BrainFusion, whether entered manually, uploaded via CSV, or generated with AI assistance. You grant BrainFusion a non-exclusive license to host and display your content as needed to provide the service.

AI-generated content: Content generated using our AI feature is created through OpenAI's API. You are responsible for reviewing and editing AI-generated content before using it with learners. BrainFusion does not claim ownership of AI-generated content created through your account.

Shared games: If you choose to share a game publicly (via the "Share Game" feature), other users may access and play it. You can disable sharing at any time.

6. Acceptable Use

You agree not to use BrainFusion to:

• Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Upload malicious code, viruses, or any content designed to disrupt the service
• Attempt to gain unauthorized access to other users' accounts or BrainFusion's systems
• Use the platform for spam, phishing, or any form of unsolicited communication
• Scrape, crawl, or use automated tools to extract data from the platform without permission
• Resell or redistribute BrainFusion's services without authorization
• Use AI credits to generate content that violates OpenAI's usage policies

We reserve the right to remove content and suspend accounts that violate these guidelines.

7. Privacy

Your use of BrainFusion is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

Key points: We collect only your email address for account creation. Learners who join games do not create accounts and provide only a display name (no personal information collected). Passwords are hashed and never stored in plain text.

8. Third-Party Services

BrainFusion integrates with the following third-party services to provide its functionality:

• Stripe for payment processing. Your payment information is handled directly by Stripe and governed by Stripe's Terms of Service.
• OpenAI for AI-powered game generation. Prompts you provide are sent to OpenAI's API. OpenAI's Terms of Use apply to AI-generated content.
• Resend for transactional email delivery (account confirmations, password resets, etc.).
• Google Analytics for understanding how the site is used.

We are not responsible for the practices or policies of these third-party services, but we choose partners who take data protection seriously.

9. Intellectual Property

The BrainFusion platform, including its design, code, branding, game mechanics, and documentation, is the intellectual property of BrainFusion Learning. You may not copy, modify, distribute, or reverse-engineer any part of the platform without written permission.

The game formats (Quiz Quest, Artifact Adventure, Ninja Fruit Frenzy, Flashcard Fusion, Helicopter Hangtime, Smart Shot) and their mechanics are proprietary to BrainFusion.

10. Limitation of Liability

BrainFusion is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that:

• The service will be uninterrupted, error-free, or completely secure
• AI-generated content will be accurate, appropriate, or free of errors
• The platform will meet all of your specific requirements

To the maximum extent permitted by law, BrainFusion Learning shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including loss of data, revenue, or profits.

Our total liability for any claim related to the service shall not exceed the amount you paid to BrainFusion in the 12 months preceding the claim.

11. Termination

You may close your account at any time by contacting support@brainfusion.games.

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in abusive, fraudulent, or illegal activity
• Fail to resolve payment issues after reasonable notice

Upon termination, your access to the platform will be revoked. Your game content may be deleted after a reasonable retention period. Any unused AI credits are forfeited upon account termination.

12. Changes to These Terms

We may update these Terms of Service from time to time. When we make significant changes, we will update the "Last updated" date at the top of this page and may notify you by email.

Your continued use of BrainFusion after changes are posted constitutes acceptance of the revised terms. If you do not agree with the changes, please stop using the platform.
